1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Angling mobile application, website, and related services (collectively, the "Service") provided by Angling ("we", "us", or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Angling is a mobile application designed for anglers to:

• Log and track fishing sessions in real time or schedule future sessions.
• Record session parameters including species caught, bait, methods, weather conditions, and personal observations.
• Generate post-session reports and timeline visualisations.
• Access weather data and environmental conditions during sessions.
• Export session summaries (Pro users).
• Access a web dashboard for multi-session analysis (Pro users).

The Service is provided on a "as-is" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate and complete.
• Keep your account credentials confidential and not share them with others.
• Notify us immediately of any unauthorised use of your account.
• Accept responsibility for all activities that occur under your account.

You must be at least 13 years of age to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. Subscriptions & Billing

Free Plan

The Free plan allows up to 10 sessions with a maximum duration of 4 hours per session. Free plan features are provided at no cost and are subject to change.

Pro Plan

The Pro plan offers unlimited sessions, unlimited duration, and additional features including Pre-history Collection, Export Summary, Web Dashboard access, and future AI insights. Pro is available as:

• Monthly: $3.99 per month, billed monthly.
• Yearly: $39.99 per year, billed annually (equivalent to $3.33/month).

Billing & Renewal

• Subscriptions are processed and managed through Apple App Store or Google Play.
• Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• You can manage and cancel your subscription through your App Store or Google Play account settings.
• We do not offer refunds except as required by applicable law or as provided by Apple or Google.

Plan Changes

You may upgrade or downgrade your subscription plan at any time. Changes will take effect at the start of the next billing period.

5. User Content

"User Content" means any information, data, text, photos, voice recordings, notes, or other content you submit, upload, or log through the Service.

Ownership

You retain ownership of all User Content you create. By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, display, and process your User Content solely for the purpose of operating and improving the Service.

Responsibility

You are solely responsible for your User Content. You represent that:

• You have the right to submit the content.
• The content does not violate any third-party rights.
• The content complies with all applicable laws.

Prohibited Content

You agree not to upload content that is illegal, harmful, offensive, or infringes on any third party's intellectual property rights.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service in any way that violates applicable local, national, or international laws or regulations.
• Attempt to gain unauthorised access to any part of the Service, other accounts, or connected systems.
• Reverse engineer, decompile, or attempt to extract the source code of the app.
• Use the Service to transmit spam, unsolicited messages, or any malicious code.
• Interfere with or disrupt the integrity or performance of the Service.
• Scrape, harvest, or collect data from the Service without our express written permission.
• Use the Service for any commercial purpose without our prior written consent.

We reserve the right to suspend or terminate access for any user who violates these provisions.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Angling. This includes but is not limited to: the app design, interface, icons, graphics, code, algorithms, and written content.

The "Angling" name, logo, and branding are trademarks of Angling. You may not use our trademarks without our prior written consent.

Nothing in these Terms grants you any right to use our intellectual property other than as necessary to use the Service as intended.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Warranties that the Service will be uninterrupted, error-free, or free of viruses.
• Warranties regarding the accuracy, reliability, or completeness of weather data or any other third-party data.

Weather data is provided for informational purposes only. Always prioritise your personal safety when fishing and do not rely solely on in-app weather information for decisions about fishing in hazardous conditions.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ANGLING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data, profits, or business opportunities.
• Damages resulting from your use or inability to use the Service.
• Damages resulting from reliance on weather, location, or catch data provided by the app.

Our total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $10.00, whichever is greater.

10. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms of Service.
• Is harmful to other users, to us, or to third parties.
• Is required by law or legal authorities.

You may terminate your account at any time by deleting the app and contacting us at the address below to request account deletion. Upon termination, your right to use the Service will cease immediately. Your session data will be deleted as outlined in our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the jurisdiction where Angling is incorporated, unless otherwise required by consumer protection laws in your region.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by:

• Updating the "Last Updated" date at the top of this page.
• Sending an in-app notification or email for significant changes.

Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service.
